Court rules on Alaafin’s case April 29

A Federal High Court sitting in Ibadan on Monday fixed April 29 for ruling in a suit filed by the Alaafin of Oyo, Oba Lamidi Adeyemi seeking to appeal a judgment by the same court.

Justice Ayo Emmanuel had fixed the date after counsel to the second respondent, Ola Adeosun informed the court that his client, Sulaiman Ishola, was yet to be duly served.

Our Correspondent reports that the monarch had earlier approached the court through his counsel, Adebayo Adegbite, to appeal a judgment of the court which had on Dec. 15, 2014 granted an order of Mandamus, compelling the Inspector General of Police (IGP) to investigate alleged criminal activities levelled against the monarch.

The order was contained in a petition to IGP office, dated March 18, 2014 and signed by Jacob Oluokun and Ishola.

The counsel to the plaintiff, Adegbite told the court that since the counsel to the second had announced appearance for his client at the previous proceedings, he has implied authority his agent for all purposes.

“The essence of service is knowledge, the second respondent can no longer claim ignorance.

“His counsels have every right to serve the processes and the issue of being served no longer arises since they have appeared. We must see to it that the case is heard without wasting the court’s time,” he said.

The counsel to the second respondent, Adeosun, however said that the service on his office was not a personal service to the second respondent.
