Dasuki refuses to face trial on arms scandal suit

Former National Security Adviser (NSA), retired Col. Sambo Dasuki Tuesday reiterated his decision not to stand trial over alleged corruption.

Dasuki, who is facing charges of illegal possession of firearms and money laundering before a Federal High Court in Abuja Tuesday asked the court to stop the trial and discharge him from the charges.

Dasuki’s counsel Joseph Daudu (SAN) argued that his client is not ready for the trial because he has not been allowed to enforce his fundamental right to liberty.

But counsels to EFCC Rotimi Jacobs (SAN) and Feyisitan Opeseyi (SAN) opposed the submission, arguing that the accused person could be arrested for another matter from the one in which the order was made.

Dasuki was granted bail by the court on November 3, 2015 but he was re-arrested by the Department of State Services (DSS) after days of siege on his residence at Asokoro, Abuja.

After two seperate high courts of the FCT granted him bail in December 2015 following EFCC charge of diversion of $2.1 billion arms funds, he was re-arrested after fulfilling the bail conditions at the Kuje Prisons.

In his ruling, Justice Ademola said that it is in the best interest of justice and fair hearing as allowed by Section 36 of 1999 Constitution that the adjournment must be granted.

The Judge also said that the court cannot close its eyes to the claim of the defendant lawyer that they have no access to their client, Dasuki to obtain fact to be used for his defence in the charges brought against him by the federal government.

The Judge ordered Dasuki’s counsel to file their response to the claim of government within 7 days and adjourned till March 3, 2016.
